1. General provisions
1.1 The rules of use of the Website (hereinafter – the Rules) determine the procedure of provision of services and payment for them offered by the website https://shop.textilis.lt/ (hereinafter – the Website) owned by UAB Textilis.
1.2 The Rules are applicable to all visitors of the Site (hereinafter – Users) who use the https://shop.textilis.lt/ website. By accessing the Website, Users confirm that they unconditionally accept these Terms and Conditions and undertake to comply with them when visiting and/or using the Website in full and/or any of the services provided therein, including Users who have not completed the registration procedure.
1.3 For the purposes of these Terms and Conditions, the term “Use of the Website” shall be understood as the performance of any action by the User when accessing the Website through electronic communication networks.
1.4 UAB Textilis reserves the right to change, modify, supplement or remove these Terms and Conditions, but undertakes to publish information about changes. The User’s continued use of the UAB Textilis website shall constitute unconditional acceptance of the changes.
1.5 The Parties agree that the relationship between UAB Textilis and the Customer, which is not covered by these Terms and Conditions, shall be governed by the laws and regulations of the Republic of Lithuania.
2. Privacy
2.1 Any personal information submitted through the Site is handled in accordance with this Site’s Privacy Policy.
3. Services available at https://shop.textilis.lt/:
3.1 Registering on the website and creating a User account.
3.2 Purchase and pay for products sold by the Company.
4. Website User registration, obligations and rights:
4.1 To become a registered user of the Website, you will need to complete a registration form.
4.2 All personal data of registered users of the Website is protected in accordance with the laws of the Republic of Lithuania.
4.3 By completing the Registration, the User undertakes to provide only correct and complete Login Data. The User is not allowed to perform the Registration using someone else’s data. The administrators of the Website shall have the right to decide at their own discretion on the truthfulness, completeness and accuracy of the Login Data provided by the User. If the User provides incorrect, incomplete or inaccurate data, the administrators of the Website shall have the right to immediately and without notice to the User not to register the User and to remove the User from the list of registered persons.
4.4 The User shall check whether he/she has logged out of his/her user account after completing his/her session on the Website. The administrators of the Website shall not be liable for any loss or expense incurred as a result of the User’s behaviour which does not comply with the Website’s terms of use.
4.5 If the user has forgotten his/her password, a message must be sent to the Website’s administrators in the Website’s authorization window to update the password by clicking on the link “Forgot your password?”. A new password will be sent to the email address provided in the user registration form.
4.6 If the User does not agree with the Terms and Conditions of the Website and no longer wishes to use the services provided by the Website, he/she may cancel the User’s registration by sending a corresponding statement to the administrators of the Website at the e-mail address info@textilis.lt. Upon receipt of the corresponding cancellation request, all personal data of the user will be deleted.
4.7 The administrators of the Website have the right to cancel a user’s registration if the user has not provided complete or accurate information as requested in the registration form. In this case, before cancelling the user’s registration, a warning will be sent to the user’s e-mail address, informing them of the problem and providing suggestions for solving the problem. If the user does not reply to the email within two working days, the user’s registration and all personal data will be deleted. After the deletion of the data, the user may re-register by providing complete and accurate information as requested in the registration form.
4.8 The administrators of the Website have the right to cancel a user’s registration without the user’s consent if the user does not comply with or violates the Website’s terms of use. In this case, all personal data of the user will be deleted.
5. Copyright and subsidiary rights
5.1 All intellectual property rights related to the https://shop.textilis.lt/ website belong exclusively to UAB Textilis. In the event of infringement of these rights, the guilty party will be held liable in accordance with the requirements of the regulatory enactments of the Republic of Lithuania and will be obliged to pay for all losses incurred by UAB Textilis as a result of such an act.
5.2 The intellectual property objects placed on the Website are protected under the Copyright Law. Any use of the intellectual property posted on the https://shop.textilis.lt/ website is permitted only with the written permission of the administrators of the https://shop.textilis.lt/ website and in accordance with these terms of use.
6. Other conditions
6.1 All disputes arising between UAB Textilis and the Visitors of the Site regarding compliance with these Rules shall be settled by negotiation. In case the dispute cannot be resolved by negotiation, it shall be settled in accordance with the procedure provided for in the normative acts of the Republic of Lithuania in force.
6.2 The content of the material provided on the Website and its compliance with the requirements of the normative acts of the Republic of Lithuania shall be the responsibility of the preparer of the particular material.
7. Returning goods
Replacement and return of fabrics of suitable quality:
7.1 In accordance with the Retail Regulations, a consumer’s request for a replacement of a purchased product of satisfactory quality with a similar product or a refund may only be granted with the agreement of the seller.
7.2 the cost of returning the quality goods or replacing them shall be borne by the buyer. Only the amount paid for the goods shall be refunded to the Buyer.
7.3 If the Buyer wishes to return the item(s), the Buyer may do so within 14 (fourteen) days from the date of delivery of the goods to the Buyer, by informing the Seller by email, attaching photographs or a video of the item and/or parcel describing the problem.
7.4 The returned Goods must be undamaged, unused, uncut, un-ironed, unworn and otherwise mechanically undamaged, and must not have lost their merchantable appearance. When returning the goods, a paper (printed) proof of purchase (copy of the order, purchase order) must be provided.
7.5 The returned goods must be in good packaging.
7.6 if the product is of good quality, the shipping costs are not refunded.
7.7 in the event of a return of the wrong product, the Seller undertakes to replace the product with the correct product. In the absence of the required item, the Buyer shall receive a full refund (for the item and the actual shipping costs incurred).
Return of defective goods:
7.8 If the goods sold have been delivered in faulty quality and the description of the goods did not specify the faults, the Buyer shall be entitled to return the goods, or the Seller may offer the Buyer a replacement of the faulty goods with goods of a suitable quality, a reduction in the price of the faulty goods with a discount for the Buyer’s next order, or a refund of the money paid for the goods and their delivery. The money shall be refunded to the bank account specified by the Buyer within 14 days.
7.9 The returned goods must be in good packaging.
7.10 due to the different resolution settings of computer monitors and phone screens, the colour of the goods may vary from one computer, phone or other device to another, i.e. it may not be the same as the colour of the goods as they appear in reality. The Buyer does not have the right to return the goods if the colour, shape, size of the goods are not satisfactory.
7.11 A tolerance of ~3-5 cm is possible when cutting fabrics. Some materials may shrink slightly due to temperature or humidity.
7.12 The Buyer may return faulty goods within 14 days of receipt.
8. Delivery of goods
Preparing orders:
8.1 We will arrange and dispatch the ordered goods within 1-3 working days after your payment is credited.
Delivery methods:
8.2 Omniva self-service terminals (only for orders up to 10 metres);
You can pick up your goods at a self-service terminal of your choice at a time convenient for you. You will receive a text message with a code. You will enter the code at the terminal and pick up your shipment.
8.3 Courier delivery to the address you specify;
8.4 Collection of the goods in our shop at Draugystės g. 15F, Kaunas, on weekdays 9:00-17:00.
Delivery prices in Lithuania:
8.5 3,50 Eur by Omnivos post office;
8.6 4,99 Eur courier delivery to your address (only for orders up to 10 metres);
8.7 9,99 Eur courier delivery to your address (for orders over 10 metres);
8.8 FREE delivery for purchases of 99 EUR or more.
